Your content and the licence you give us
You own the photos, captions and other content you post (“Your Content”). You confirm that you have the rights needed to post it, including permission from anyone else who appears in it.
You grant Dayly a non-exclusive, royalty-free, worldwide licence to host, store, reproduce, display, format and distribute Your Content solely to operate, provide and improve Dayly — for example, showing your posts in feeds and on leaderboards according to your visibility settings. This licence ends when you delete the content or your account, except where it has been shared by others under these Terms or we must retain it by law.
[Product decision: confirm whether Dayly may use public posts in its own marketing or share them with brand partners. If yes, this requires explicit, separate opt-in wording.]
Ratings, comments and leaderboards
- Members may rate eligible posts from 0 to 10, like and comment. You can turn ratings off for your posts.
- Ratings express personal taste. They are not professional assessments, and Dayly does not endorse any rating or comment.
- Leaderboards are computed automatically from ratings, the number of votes and other signals, and may change at any time. Positions carry no prize or entitlement unless we say so in separate official rules. [Product decision: if rewards, prizes or sponsored challenges are planned, publish separate contest rules]
- We may remove ratings, reset scores, or exclude content or accounts from leaderboards to protect integrity, as described in our Content & Rating Policy.
Privacy settings and your responsibilities
You control who sees each post (public, followers-only or private) and whether it can be rated. Content you make public can be seen by other members, who may remember or screenshot it; please think before you share. Read our Privacy Policy to understand how we handle personal data.
Reporting, blocking, suspension and termination
Commonly required disclosure · IT Rules 2021
- You can block members and report content or accounts from within the App.
- We may review, restrict or remove content and suspend or terminate accounts that breach these Terms, our guidelines or the law, or where required by a court or government order.
- Where appropriate we will tell you about action taken and give you a way to appeal.
- You can stop using Dayly and delete your account at any time — see Account Deletion.
We may also suspend or discontinue all or part of the service, with reasonable notice where practical.
Intellectual property and trademarks
Dayly, the Dayly wordmark, the App, its design, software and content (other than Your Content) belong to [To confirm: registered legal entity name] or its licensors. Dayly is provided “as is” and “as available”. To the extent permitted by law, we do not warrant that the service will be uninterrupted, error-free or secure, or that any content, rating or ranking is accurate. Limitation of liability
To the extent permitted by law, Dayly will not be liable for indirect, incidental, special or consequential losses, or for loss of data, goodwill or profits, arising from your use of the service. Our total liability for any claim relating to Dayly is limited to [To confirm: cap, e.g. the greater of amounts paid by you in the last 12 months or a fixed INR amount]. Nothing excludes liability that cannot be excluded by law.
Indemnity
You agree to indemnify Dayly against third-party claims arising from Your Content or your breach of these Terms or the law, to the extent permitted by applicable law. [To confirm: counsel to confirm enforceability for consumer users]
